The Electoral Public Prosecutor (MPE) defended on Wednesday the 12th the suspension of the political rights of former President of the Republic Jair Bolsonaro (PL), which in practice would render him ineligible. The opinion was sent late Wednesday evening to the Higher Electoral Court (TSE).
The document signed by the deputy attorney general for elections, Paulo Gustavo Gonet Branco, was attached to the action regarding Bolsonaro’s meeting with foreign ambassadors at the Alvorada Palace in July last year.
The then president spread false news about the polls and cast unfounded suspicions about the health of the electoral process.
In the evaluation of the Electoral Prosecutor, Bolsonaro has abused political power.
Abuse of political power occurs when a candidate uses office to try to improperly influence an election. The penalty provided by the electoral law is ineligibility for a period of eight years.
It is up to the TSE to decide whether to leave the former president inelectable. The rapporteur of the action is Minister Benedito Gonçalves. The expectation is that the case will be judged in plenary until the beginning of May.
The draft of the coup was also included as evidence in the trial
The draft coup seized by federal police from the home of Bolsonaro’s former justice minister Anderson Torres was included as evidence in the trial.
The draft envisaged an intervention by the president and members of the Ministry of Defense in the TSE to nullify the election result.
Bolsonaro’s defense claims the document is apocryphal and cannot serve as evidence. This week he sent his closing arguments in the lawsuit.

Other incidents of attacks on the electoral system have been included in the list of evidence of the action. The TSE also listened to former Minister of Civil Affairs, Ciro Nogueira, and Admiral Flávio Augusto Viana Rocha, former special secretary for strategic affairs of the presidency, to try to understand how the government structure was used to organize the ‘encounter.
Ciro Nogueira denied having participated in the organization of the event.
