The deputy impeached by the Superior Electoral Court can appeal, but must wait off-site
the deputy Deltan Dallagnol (Podemos-PR) can still try to overturn the ruling of the Higher Electoral Tribunal (TSE) which revoked its mandate on the basis of the Criminal Record Law.
Appeals can be addressed to the TSE itself and to the Federal Supreme Court (STF). The decision taken on Tuesday 16, however, has immediate effect, which means that Dallagnol must await the outcome of the off-site case.
“Since this is a decision issued during the appeal, other appeals proposed by Dallagnol’s defense do not have the effect of suspending the impeachment”, he explains to Stadium lawyer Luiz Gustavo de Andrade, specialist in electoral law and member of the Brazilian Academy of Electoral and Political Law (Abradep).
The TSE annulled Dallagnol’s candidacy record on the basis of trying to circumvent the Clean Record Law. The vote was unanimous. With the decision, the former attorney general is also ineligible for eight years.
The ministers concluded that Dallagnol had asked for his resignation almost a year before the elections to free himself from disciplinary proceedings which, if they go ahead, could prevent his candidacy.
In a note, the deputy said that the TSE had ‘silenced’ the voices of its constituents and said he was indignant at the decision. The court decided that the marks he received should go into legend.
