The substitute judge of the 5th Judicial Section of the Federal District, Diana Wanderlei, canceled the inauguration of the president of the Brazilian Agency for the Promotion of Trade and Investments (Apex-Brazil), Jorge Viana, on Monday 22nd. The lawsuit was filed by Senator Flávio Bolsonaro (PL-RJ). In the ruling, the judge gave Viana a deadline to present an English language proficiency diploma or even a video of him appearing speaking the foreign language. In the injunction, the magistrate specified that the offices of president and director of the institution are eminently administrative, not of a political nature.
“When we talk about Apex-Brazil, the institution’s primary objective, as we have seen, is to favor the implementation of export promotion policies, which obviously takes place in the context of international relations. And, in this business environment, becoming aware of the ‘mater language’ of international business is of paramount importance to the executive structure,” wrote Diana.
Also according to the decision, there was a deviation from the purpose with the modification of the bylaws of Apex-Brasil by the Deliberative Council. The change occurred at Viana’s request. Article 23(4) of the statute required a certificate of proficiency or a certificate of completion of an advanced level English course. The new text only states that, “preferably”, the president and directors “should have a fluent knowledge or an advanced level of the English language”.

According to the AGU, the authors of the trial did not possess the essential procedural requirements for bringing the action. “Nor have they demonstrated the actual harm caused by the act of appointment. The AGU will demonstrate to TRF-1 the need to declare the groundlessness of the demands conveyed in the popular action and bring about the immediate return of Viana to the presidency of ApexBrasil,” the body added.
