Eduardo Bandeira de Mello, seven other defendants and witnesses will appear before the judge in August
Judge Tiago Fernandes de Barros, of the 36th Capital Criminal Court of the Rio de Janeiro State Court of Justice (TJRJ), scheduled late Thursday for August 18 this year, at 1:00 pm, the hearing of education and the trial of the fire of the Ninho do Urubu, in February 2019, in which the players of the youth categories of Flamengo ended up dying. On this day Eduardo Bandeira de Mello, former president of Rubro-Negro, will be heard for the first time as a defendant in court.
Esporte News Mundo had access to the details of the case. In addition to Bandeira de Mello, currently a federal deputy (PSB/RJ), the defendants Antonio Marcio Mongelli Garotti, Claudia Pereira Rodrigues, Danilo da Silva Duarte, Edson Colman da Silva, Fábio Hilário da Silva, Marcelo Maia de Sá and Wesley Gimenes. The magistrate established that on that date not only the accused, but also all the witnesses listed by the interested parties should be summoned for the hearing.
This step is important to try to settle the case in the first instance. The instruction and hearing is a procedural act to produce oral evidence in legal cases. It is during it that the parties give personal testimony, experts testify, as well as other people involved in the trial. Also present at the hearing are the Public Prosecutor of the State of Rio de Janeiro (MPRJ) and the Public Defender of the State of Rio de Janeiro (DPRJ).
Monitor Marcus Vinícius Medeiros, it is worth noting, was the first summarily acquitted in the trial (out of three), which has been ongoing at the TJRJ since 2021. He even filed a lawsuit against Flamengo in the regional labor court of the first region (TRT-1) and, in March of this year, emerged victorious with Flamengo convicted of non-pecuniary damages, as anticipated by the ENM, for a total of R$ 170,000.
The eight accused of the tragedy of the Flamengo Training Center, in Vargem Grande, in the West Zone of Rio de Janeiro, are responsible for a qualified arson, when there was no intention of the practice, and which ended in the death of ten players , as well as grievous bodily harm, in the case of the three surviving athletes. If convicted, they can face prison terms of up to four years, increasing by one-sixth to one-half.
