Ministry of Labor prepares proposal to allow workers dismissed without just cause to withdraw the FGTS even if they have opted for the withdrawal method on the occasion of their birthday
The minister of Work, Luiz Marinhodeclared on Monday 23rd that the government’s plan is to change the rules for the withdrawal of Service Time Guarantee Fund (FGTS) they will be delivered to Congress “within the next week.” He specified that in the next few days there will be a definitive order with the president, the Civil Chamber, the Ministry of Finance and the Caixa Econômica Federal to resolve the issue.
Marinho made the statements to journalists in the Palácio do Planalto after a meeting with President Luiz Inácio Lula da Silva.
The conversation with the minister was Lula’s first appointment at Planalto since September 29, when he underwent hip surgery to correct arthrosis.

The anniversary loot was created in 2019, under the government of Jair Bolsonaro. Those who opt for FGTS under this scheme can withdraw a part of the balance annually in the month of their birthday, but cannot withdraw the entire balance if they are dismissed without just cause.
According to him, before the project passes to Parliament, a meeting will be held with the presidents of the Chamber, Arthur Lira (PP-AL), and the Senate, Rodrigo Pacheco (PSD-MG), to discuss the topic. “There is no agreement regarding the delivery boys,” he informed. “We need to prepare a bill to present to the president based on closed concepts for the transportation of people,” he commented.

Another topic discussed with the president was the release of the new general register of employed and unemployed (in cages) for September, next week.
According to Marinho, the forecast of creating 2 million jobs this year is maintained.
