The Board of Directors of the Federal Regional Court of the IV Region approved the musical chairs dance in the federal courts of Curitiba, confirming the transfer of judge Danilo Pereira Júnior to the XIII Federal Criminal Court in the capital of Paraná – home of the extinct Operation Lava Jato. The provision was issued this Monday 27th.
Danilo was the judge in charge of determining, in 2019, the release of President Luiz Inácio Lula da Silva after the Federal Supreme Court had declared the arrest unconstitutional in second degree – after having been condemned by the then judge Sérgio Moro, in first instance degree, A member of the PT had his sentence aggravated by the Federal Regional Court of the 4th Region (TRF4).
Judge Eduardo Appio – Moro’s disaffected and who had inherited the remaining Lava Jato cases between last February and May – will take over the leadership of the 18th Federal Court in Curitiba, where simple cases on social security issues are heard.
Last October Appio had signed an agreement with the National Council of Justice, renouncing to resume the collection of Lava Jato after his dismissal and with the indication that he would request the transfer to another “less controversial” judicial unit.
The changes had already been announced by the Federal Court of Paraná after the closing of registrations for the competition to dismiss the magistrates of the jurisdictional units of the IV Region, which includes the federal courts of Rio Grande do Sul, Santa Catarina and Paraná.
At the time it was possible to indicate the courts that Appio and Danilo will take on based on the seniority criterion – a rule according to which the judge with the longest career has preference when asking to occupy a specific role and place of work in the federal sphere . Court.
Now the changes have been approved by the Administrative Council of the Regional Court. With this decision another chapter opens for Lava Jato, which has gone through turbulent months this year.
When Appio took charge of the 13th Federal Court of Curitiba, his orders caused a stir, especially in sensitive investigative cases, such as that of the lawyer Rodrigo Tacla Duran, who accused Moro, and the former prosecutor Deltan Dallagnol, former head of the Federal task force Public of the Ministry in Lava Jato.
Three months after starting to decide on Lava Jato, Appio ended up dismissed, in the middle of an investigation that attributed to him an alleged threat to judge Marcelo Malucelli, of the Federal Regional Court of the IV Region. Appio would have telephoned the judge’s son, the lawyer João Malucelli, Moro’s son-in-law and partner.
Appio and Malucelli had already been involved in friction before this episode, but the opening of the disciplinary complaint against the judge of first instance and the consequent discovery of Malucelli’s connection with Moro meant that judge Malucelli declared himself banned from the cases Lava Jato second degree. .
The scam has placed the Lava Jato base, both 1st and 2nd degree, in the sights of the National Justice Inspectorate.
Minister Luis Felipe Salomão searched the 13th Federal Court of Curitiba and the offices of the judges of the 8th Commission of the TRF-4.
The investigation highlighted irregularities in the management of the leniency and denunciation agreements signed by Lava Jato. Following what was ascertained, the CNJ decided to open an investigation into the conduct of Moro and the TRF-4 magistrates who worked on the Operation.
