The previous week, the Court of Justice of Rio de Janeiro had deposed President Ednaldo Rodrigues, appointing an intervener to organize a new election, a decision later confirmed by the Superior Court of Justice.




According to “ge”, in a joint letter signed by the directors of the two entities, FIFA and CONMEBOL warn the CBF that no elections should be called or held until a delegation of international entities visits Brazil in January to assess the situation and discuss the question. with the parties involved.

The CBF is now faced with a dilemma, as it cannot fail to comply with the decision of the Superior Court of Justice, at the same time it must comply with the decision of FIFA.

The letter highlights that, pursuant to Article 64 of the CBF statute, in the event of absence from the office of president, the most senior director is the only person authorized to represent the CBF and assume the responsibilities of interim president. In addition to Ednaldo Rodrigues, its eight vice presidents elected in 2022 were also removed.

The current most senior director is Hélio Santos Menezes, who currently holds the confederation’s legal and governance roles. All CBF communications with FIFA and CONMEBOL must be signed by him and the board has not been removed.

In this scenario, no authority other than that mentioned in Article 64 will be officially recognized by FIFA and CONMEBOL, as indicated in the letter.

The document warns of the possibility of “relevant sanctions” for the CBF if undue interference with the statutes of FIFA and CONMEBOL is found. However, experts and officials believe that there is no risk of sporting punishment for Brazilian football.

The example often cited by FIFA and CONMEBOL officials is that of Argentina, which, between 2016 and 2017, was administered by a “Normalization Committee” at the AFA (Argentine Football Association) to reform the statutes and call new elections.

The TJ-RJ’s decision, supported by the STJ, ruled that José Perdiz, now a graduate of the Superior Court of Sports Justice (STJD), organize new elections within 30 working days, starting December 12. José Perdiz, commenting on FIFA’s letter, expressed satisfaction and respect, considering it a positive sign that the entity follows the electoral process at the CBF. He reiterated his commitment to calling the elections within 30 days, following the principles of transparency and clarity required by Brazilian justice.
