The former president of the Federal Court is expected to be announced this Thursday to fill the place of Flávio Dino, who will go to the STF
BRASILIA – Former President of the Federal Supreme Court Ricardo Lewandowski will be the new Minister of Justice and Public Security. Lewandowski accepted President Luiz Inácio Lula da Silva’s invitation to replace Flávio Dino, who will join the Federal Supreme Court (STF) in February.
Dino and the retired magistrate met with Lula on the night of this Wednesday the 10th at the Palácio da Alvorada. The appointment is expected to be announced this Thursday, at a meeting scheduled for 11am, at the Palácio do Planalto.
With Dino’s exit and Lewandowski’s entry, the Ministry of Justice should act with more discretion. In private conversations, Lula’s allies argue that the former STF president does not have the same confrontational profile as Dino, who was involved in several clashes with followers of former president Jair Bolsonaro.
Although Lula thought about recreating the Ministry of Security, an election promise, the idea did not go ahead. The separation was considered very delicate because structures such as the Federal Police and the Federal Traffic Police, for example, would have to leave the jurisdiction of Justice.
Furthermore, despite research indicating that crime and drug trafficking are among the country’s major problems, Lula estimated that separation would end up transferring the entire problem of public security to the federal executive. According to the Constitution, security is the responsibility of governors.
The most popular name to occupy the executive secretariat of the Ministry of Justice is that of jurist Manoel Carlos de Almeida Neto. Lewandowski wanted Almeida Neto to be nominated by Lula to fill his seat on the Supreme Court when he retires in April 2023. At the time, however, the president preferred to appoint Cristiano Zanin, who was his lawyer during the Operation Lava Jato.
The friendship with Lula dates back to the 70s
Lewandowski met Lula when the PT member was a union member in the 1970s in São Bernardo do Campo, ABC São Paulo. In May 2016, when he presided over the Supreme Court, he led the impeachment session of then President Dilma Rousseff shortly after the Senate plenary decided on the admissibility of the request. At the time, he helped create the agreement so that Dilma would not lose her political rights, even after she was impeached.
Since the beginning of the week, Lewandowski has spoken to Lula about his expectations for the Ministry of Justice, but asked for time to define the second level. Until the evening of this Wednesday the 10th, he, Dino and Lula were still discussing what would be the fate of the current executive secretary of the ministry, Ricardo Cappelli.
It was after the coup attempt on January 8th that Cappelli became famous when he took charge of the public security intervention in the Federal District. In Rio, he also conducted several meetings to monitor the Law and Order Guarantee (GLO) operation, launched in November last year at ports and airports.
The director general of the Federal Police, Andrei Rodrigues, will continue to lead the company, but the current national secretary of Security, Tadeu Alencar (PSB), appointed by Dino, will leave his position.
Dino will leave the PSB to take Rosa Weber’s place on the Supreme Court. The PSB has in its government Vice President Geraldo Alckmin, who is also Minister of Development, Industry, Trade and Services, and the head of Entrepreneurship, Microenterprise and Small Business, Márcio França.
The secretaries Augusto de Arruda Botelho (Justice) and Ênio Vaz (Legislative Affairs) are also affiliated with the PSB and until the evening of Wednesday the 10th it was not known whether they would remain in the team. Of the PT share, the Minister of Consumer Affairs, Wadih Damous, is expected to remain in office.
