The former player Daniele Alves was sued in the Superior Court of Barcelona this Thursday the 22nd, according to the Spanish newspaper La Vanguardia.

All parties involved in the prosecution process against Alves for sexual assault were summoned, including the prosecutor Elisabet Jiménez, the prosecutor and the complainant’s lawyer, Ester García, and Daniel’s defense, represented by the lawyer Inês Guardiola.

Accused of raping a young woman in the bathroom of a nightclub in Barcelona in December 2022, the trial against the former Brazilian player ended on the 7th, after three days, with the testimony of the Brazilian, who cried during his speech and claimed the relationship was consensual.

During the deposition, the former athlete also stated that he had consumed alcohol and that he had not forced the complainant to enter the bathroom where the alleged sexual assault had occurred. Daniel’s defense asked for parole and his acquittal.

The penalty for this type of crime is up to 12 years in prison, but the Prosecutor’s Office is asking for nine years in prison. The trend, however, is for Brazilians, if convicted, to remain in prison for a maximum of six years. This is because at the beginning of the legal proceedings the player’s defense paid the court the sum of 150 thousand euros (around 800 thousand reals).

The woman’s lawyer disputes the possible reduction of the possible sentence. The deputy also asked for ten years of probation after serving his prison sentence and that he be prohibited from approaching the victim or communicating with her for the same period.
