Rio Grande do Sul court orders the federal government to pay R$100,000 to the family of a Samu rescuer who died of Covid-19

The First Federal Court of Gravataí, in the metropolitan region of Porto Alegre, ordered the federal government to pay R$100,000 to the family of a Samu (emergency mobile assistance service) rescuer who died due to Covid-19.




According to information released on Friday evening (1) by the Federal Court, the man’s wife and son have filed a lawsuit against the Union claiming that the rescuer died at the age of 45 due to the disease. They said he worked as an emergency driver for Samu in the Palmeira das Missões region, in the north of the state, for more than five years, starting in June 2014 and remaining active until he was infected with the coronavirus, precisely because has worked on the safety front in the fight against the disease.

Analyzing the evidence attached to the case, Judge Bruno Polgati Diehl noted that it attested to the work carried out by the man and the causes of his death. He noted that law 14.128 / 2021 defines that families of healthcare workers who died due to Covid-19, who worked in the direct care of patients suffering from this disease, are entitled to financial compensation.

The judge said the law provides that families of deceased workers are entitled to receive compensation of R$50,000, which must be divided equally between spouses and dependents. In respect of the son, according to the law, a share calculated by multiplying R $ 10 thousand by the number of whole and incomplete years that were missing, at the date of the father’s death, for him to turn 21. Diehl concluded that the boy was entitled to R$50,000, considering that he was 16 years old at the time of his death.

In its defense, the Union argued the existence of budgetary constraints, its negligence and failure to meet accountability requirements. The decision can be appealed to the TRF4 (Federal Regional Court of the 4th Region).
