The STJ authorized the execution of the sentence in Brazil
Former player Robinho’s defense has filed a habeas corpus with the Federal Supreme Court (STF) to prevent him from being arrested before exhausting all appeal options.
The provision comes after the decision of the Superior Court of Justice (STJ) to validate Italy’s request for the former star to immediately serve a nine-year prison sentence in Brazil in a closed regime for rape, a crime committed at the time in which he played for Milan in 2013.
According to Robinho’s lawyers, he “has never posed a risk for the application of national legislation”, and should therefore remain free “until the final decision of the discussion”.
The defense states that it is “plausible” that the STF will annul the STJ’s decision because it believes that ratifying the sentence in Brazil is “contrary to the Constitution of the Republic”.
Former star of clubs such as Santos, Real Madrid, Manchester City and Milan, Robinho and his friend Ricardo Falco were finally convicted in Italy for the rape of a 22-year-old Albanian girl.
Four other suspects escaped trial because they were not identified by the European country’s courts. .
