The TSE allows the use of brand names and private company names in the naming of ballot boxes


Monday’s ruling ruled that candidates in this year’s municipal elections will be able to use commercial names in their profiles in the voting booth.

Candidates for mayor, deputy and councilor will be able to include names with brands or acronyms of private companies on the ballot paper during municipal elections this yearaccording to the decision of the Superior Electoral Court (TSE) this Monday 1. The ruling is based on a question from federal deputy Simone Marquetto (MDB-SP) regarding the ban on brands in election advertising and its extension to the name of ballot boxes. According to the rapporteur on the issue, Minister Raul Araújo, there is no express rule that prohibits the presence of a brand associated with companies as part of the name of the candidate in the ballot boxes.

He was accompanied by three other members of the collegiate, the ministers Nunes MarquisIsabel Galloti and André Mendonça. Ministers Floriano de Azevedo Marques, André Ramos Tavares and CarmenLuciapresident of the TSE.

In his vote, Araújo said that the practice of associating names with establishments or institutions is already common in Brazil, especially in municipal elections. It is on this occasion that, for example, candidates such as “Fulano do Posto” and “Sicrana da Farmácia” multiply, according to the minister.

Nonetheless, the same ruling unanimously reiterated that corporate brands, products and acronyms cannot be used in electoral propaganda.
