The Court of Santa Catarina has set a 30-day deadline for the state government to provide sexual reassignment surgery for a trans woman from Florianópolis through the Unified Health System (SUS). Ashley Costa, 39, has been waiting for the surgery for more than two years.
The decision was issued last Thursday (27) by the State Office of Public Defense (DPE). The State Department of Health (SES) warned that it will abide by the decision, but did not provide further details on when and where the procedure will be performed.
In addition to the government of Santa Catarina, the city of Florianópolis is also a defendant in the case. According to the DPE, the case is unprecedented, as there are no known similar precedents in Santa Catarina. The recent decision came after Ashley contacted the Public Ministry, in 2023, and the DPE, at the beginning of the year, to report the wait for surgery in the state. Since Santa Catarina does not have a public referral hospital for the procedure, she was placed on the waiting list in Goiás, occupying the 304th position in the queue.

The court order allows the surgery to be performed in a private clinic if the defendants do not comply with the deadline. During the proceedings, medical reports and an express prescription of the urgency of the surgery were presented. According to the DPE, Ashley Costa suffers from “suicidal ideation and risk of self-harm”, as well as “psychogenic urinary retention, also related to genital dysphoria”.
Her health problems prevent her from working or even leaving the house. “The greatest feeling I have is to free myself from all this and return to a normal life, because today I am a prisoner at home,” she said in an interview with g1.
