In a video made by her mother, who appears in tears in the recording, the little girl declares that she did not steal anything. The family had bought sweets worth more than R$500 to celebrate the boy’s birthday, who had turned two days earlier. The images had repercussions on social media.
Security camera footage from the site also showed the moment the manager approached the mother, son and father, street vendor Diego Brasil dos Santos, 29, all in black. They were in line at the checkout when it all happened.
After accusing the boy of eating cookies and hiding the empty package behind the shelves, the store clerk claimed the incident was captured on company cameras, according to the family. Giovanna asked for the footage and, after the manager reviewed it, rephrased it, saying it was a mistake and apologized.
“This can’t happen, for God’s sake. I want justice. We are black, but let’s be honest. This was racism, prejudice,” the woman wrote in the caption of the video she shared on social media.

Giovanna Santos contacted the Civil Police after the incident, who registered the episode only as “slander” in the 44th Police District (DP), Guaianazes, in the eastern part of the capital of São Paulo. Earth WEThe Secretariat of Public Security (SSP) has informed that the crime to be investigated may change during the investigation.
“The investigation into the case continues by the 54th DP (Cidade Tiradentes). All the images of the place have been collected and analyzed. The mother of the minor has already been notified to provide clarifications, with the aim of collaborating in the investigation. The investigation investigates the crime of defamation, which may be modified during the investigation, depending on new evidence”, he reported.
Magical sweets
Magic Doces even posted a statement on social media, acknowledging the employee’s mistake in accusing the boy without evidence. The store also said it “does not tolerate, under any circumstances, discriminatory or prejudicial attitudes.”
“The employee involved is being followed up and, after a thorough investigation of the facts, if any irregularity is found, all measures will be taken to ensure that no other similar event occurs in our company,” Magic Doces commented in a note that had been removed from social media.

Crime of racism
The crime of racism is provided for by law 7.716/1989 with imprisonment from one to three years and a fine. The crime is imprescriptible and not subject to bail. According to the law, racism is “practicing, inducing or inciting discrimination or prejudice based on race, color, ethnicity, religion or national origin”.
