Deolane Tries to Silence Leo Dias and the Courts Prevent Him


The former Fazenda wanted to prohibit a journalist from mentioning his name, but the trial was also not entitled to secrecy




The Court of Justice of the State of São Paulo (TJ-SP) denied the emergency measure requested by Deolane Bezerra, a pretrial detainee in Recife, against journalist Leo Dias for moral damages. The lawyer sought to prohibit the columnist from mentioning her name on the Internet and television, as well as forcing him to delete all the posts in which she was involved.

In the lawsuit, the defense attorney accused Leo Dias of “having made successive pejorative comments about Deolane’s image, linking and implicating his conduct to alleged criminal and illegal practices, as well as having uttered insults, with the clear intent of creating friction with the author and his family.” But the court argued that the journalist’s freedom of expression could not be taken away, nor could the case be kept secret.

Judge Renata Bittencourt Couto da Costa explained that Deolane is a digital influencer with a significant number of followers on social media, in addition to having her life completely exposed on the Internet. She understood that it is not necessary to “hide” the judicial process.

“The intended broad injunction restricts the right to freedom of expression and thought, which does not prevent the defendant from being held liable for excess, abuse and irregular exercise of the right,” the judge said, recognizing Leo Dias’ right to publicly defend any action brought by the former Treasury Department for moral damages.
