Prevented for a period from attending Alviverde matches, Nelson Gonzaga expressed regret for the gesture in a statement to the Civil Police
As a precautionary measure, the São Paulo court has banned Nelson Gonzaga de Oliveira from Palmeiras matches for the next six months. The fan became the subject of investigation after he showed his genitals to the Botafoguense player in the stands of Allianz Parque on August 21. Palmeirense is still appealing.
Nelson admitted to having committed the act and expressed regret in a statement given to the Civil Police on the 26th. The Palmeiras native denied that the act was directed specifically at the woman, but supported the idea of a generalized provocation against Botafoguenses.
Palmeiras and Botafogo drew 2-2 on that occasion, and Cariocas advanced to the quarterfinals of the Libertadores on aggregate. Alviverde was eliminated from the tournament almost a week after falling to Flamengo in the Copa do Brasil.
Declaration to the Civil Police
In addition to justifying the intentions of the act, which he called “unthinkable”, Nelson filed additional complaints with the Civil Police. He said he had consumed a significant amount of alcohol and was taking controlled drugs.
He later said he “totally regretted his behavior” and called it impulsive. Nelson said he would like to apologize to the clubs’ fans, as he “knows a lot of women support both or join them.”
Oliveira made a statement at the Sixth Police Station for the Repression of Crimes of Sports Intolerance (Drade).
precautionary measure
Judge José Fernando Steinberg accepted the request of the Civil Police and defined, on Monday (16), a precautionary measure against Nelson. The decision was made in the first instance and, therefore, can be appealed.
“The imposition of the precautionary measure appears necessary and appropriate, considering that the conduct of the suspect may give rise to disorder, disturbances and uncontrollable fights inside the stadium, generating insecurity, making the environment hostile to other attendees”, writes the investigating judge.
Excerpt from the judgment
“In this sense, in order to avoid the possible reiteration of the concluded conduct practiced, determining the impediment of the confrontation of the suspects inside and around the football stadium when a Palmeiras match is held, professional or amateur, which takes place in the city of São Paulo, State of São Paulo, Brazil or abroad, when the latter is at home or visiting, in all championships or friendlies played for a period of six months”.

Palmeiras matches suspended
Any failure to comply with the six-month suspension of Palmeiras matches could result in preventive arrest. In addition, during the validity of the sanction, Nelson Gonzaga must present himself at the place indicated by the Center for Sentences and Alternative Measures two hours before the club’s matches. The Palmeiras player must remain there until 15 minutes after the start of the duels or until the end, in the case of night performances.
