Court orders company to pay R$69,000 to Peruvian woman for sexual and moral harassment


Former employee, who worked at the company from 2015 to 2018, reported the manager for stalking, crimes and sexual harassment




The Labor Court has won the case of a former employee of a logistics company linked to the Korean group Hyundai, who will receive R$ 69,000 in compensation for sexual and moral harassment. The company attempted to appeal the decision, but the appeal was rejected by the Superior Labor Court (TST).

The decision was made by the 8th Panel of the TST, which examined the case after the conviction of Glovis Brasil LogĂ­stica in the first and second instance.

The woman had been hired by the company, located in Piracicaba (SP), in 2015, to act as a transport driver for other employees, in a role known as ‘perueira’. She held the position until 2018 and, the following year, she sued the company.

In the proceedings, she said she was the only woman in the role and was harassed and abused by the sector manager, who called her ‘stupid’, ‘dimwitted’ and ‘incompetent’.

When alone, the former employee was embarrassed by disrespectful and sexual questions, as well as being asked to go out with her boss. She even filed a police report.

First, the Court found that the manager had aggressive behavior, especially toward women. Witnesses reported a hostile environment, of a sexual and gender nature, a constant practice of intimidation and exclusion of women.

The company appealed after being sentenced to compensate the employee with R$ 69,000, equivalent to thirty of his salary, and the case was taken to the Regional Labor Court of the XV Region (Campinas, SP), which upheld the sentence.

The company eventually took the case to the Federal Court, but the appeal rapporteur, named Judge Marlene Teresinha Fuverki Suguimatsu, found that the appeal was not qualified because it did not meet the formal requirements of the CLT, such as the correct identification of the parties to the TRT decision.

The conviction was unanimously upheld, TST reported. IL Earth I tried to contact the company, but I did not receive a response. The space remains open for demonstrations.
