The Minister of Justice and Public Security (MJSP), Ricardo Lewandowski, signed an order (nº 830/2024) on Wednesday 18th which removes the power of investigation from the Federal Highway Police (PRF), a decision that had been defined by a regulation presented during the administration of former president Jair Bolsonaro.
The new ordinance defines the rules for the participation of the PRF in joint operations with other bodies of the Unified Public Security System (Susp).
Among the measures it is established that the body will not be able to exercise exclusive powers of the judicial police, such as investigating crimes – according to the Federal Constitution, this function belongs only to the civil police and the federal police.
The ordinance also establishes that the participation of the PRF in joint operations with other police forces must receive the authorization of the director general of the body, who will have to explain the reasons for the operation, as well as specifying the resources that will be used and the expected costs. the action.
In exceptional situations, such as public disasters or serious threats to public order, the Minister of Justice and Public Security can also authorize the use of the Federal Traffic Police in collaboration with other Susp bodies.
Current operations will have a 90-day period to adapt to the new rules, the ministry says.
