Minister Alexandre de Moraes of the Federal Supreme Court (Stf) granted requests from the defense of the former president Jair Bolsonaro (PL), Lieutenant Colonel Mauro Cid and General Augustus Heleno to fully access the evidence collected by the Federal Police (PF) in the investigation into the investigation.
In the decision published on Wednesday 30, Moraes stressed that the first class of the Supreme Court had already unanimously rejected the accusations of the defenses that require the process of absence of broad and unlimited access to the tests in the receipt phase of the “Core 1” relationship, of which Bolsonaro and the other applicants are part.
The minister said that lawyers had access to the complete case and test documents several times during the investigations and after the precautionary measures.
Although he considered that the accusations had already been correctly analyzed and removed, the minister authorized access to the media and materials seized by the police during the investigations, even those that were not used to formulate the complaint. Moraes asked the PF to inform, within five days, what is the best way for the prosecutor’s office (PGR) and defenses to have access to the materials.
Any documents containing intimate facts connected to private life should be maintained reserved, but if the defenses want to access, they must make specific requirements.
In the same decision, the minister authorized the auditions of the defense witnesses requested by Bolsonaro. Among the 15 names are the governor of San Paolo, Tarcísio de Freitas; the former vice -president, General Hamilton Mourão; The former Minister of Health and the Federal Deputy, Eduardo Pazuello (PL-RJ) and the Senator and President of the PP, Ciro Nogueira (PI). Moraes underlined that in the case of witnesses of indemnity, that is, those who will testify exclusively to speak well of the character, reputation or social conduct of the accused, the declarations must be replaced by written declarations.
The witnesses indicated by the other accused were also authorized by the rapporteur of the case, with the exception of the request of Anderson Torres, who listed 37 witnesses in his previous defense. According to the minister, the defense did not correctly indicate what witnesses would have been listened to in relation to each of the crimes attributed by the complaint, which, from criminal proceedings, admits up to eight witnesses for any alleged criminal fact. Moraes gave 48 hours to defend the former Minister of Justice of Bolsonaro to indicate the witnesses.
The defenses of Bolsonaro and General Walter Braga Netto also asked the Minister to participate in the hearings of the other nuclei involved in the coup, a decision that, according to Moraes, will be made later in the trial. There was also a request that “a television was available to show all the members of the first class the tests that are (and will be) produced in the file”, and the minister also said that there will be a future analysis.
Last month, the first class of the court accepted PGR’s complaint against the former president and seven other allies for the integration of the “crucial nucleus” of the criminal organization that tried to give a coup in the country.
