The order regulates a measure foreseen for MP, for which the union, the states and the municipalities can acquire foods that are no longer exported due to the supplement of the United States
Brasilia – O Lula government flexible government purchases regulated to absorb part of the products affected by Tariff of the United States. The regulation was published with an interministerial decree of the Ministry of Agricultural Development and Family Agriculture and the Ministry of Agriculture, in Extra Edition in the Official Gazette, Friday evening, 22.
The order provides that they can be purchased through flexible government purchases:
- Acai (fruit, puree and preparations)
- Coconut
- Also (Rija -or -Peek Fruits, fruit juices and vegetable extracts)
- Brazil walnuts (Brazil walnuts, fresh or dry, without shell)
- Mango (fresh or dry)
- Honey
- Fish (like Corvina, Congo, Tilapia and others)
- fresh grapes
Beef and coffee were excluded from flexible purchases, as expected in the Estadão/Transmission.
The flexibility of government purchases was authorized in the context of Provisional measurement n. 1,309/2025, which establishes an emergency plan for the sectors affected by the rateTHE. The parliamentarian exceptionally authorizes that they can be acquired by the Union, States and Municipalities that have stopped being exported due to the imposition of further rates of the United States.
The exceptional acquisition of food provides for the MP, will allow direct hiring with the exemption from the offer, will admit the simplified presentation of the reference term and extend to the processing of preliminary technical studies.
In addition to the simplified procedure, the products can be purchased the average market price, according to MP. The hiring can be carried out within 180 days from the publication of the MP on August 13th.
The order provides that the procedures are exceptional and emergency regarding purchases of public food in an exclusive service to the producers and the export of legal entities affected by the US import supplement.
The list of eligible food for flexible government purchases can be updated in a new joint act of ministries, establishes the ordinance.
For the sale of products for flexible government purchases, exporters must submit a declaration of loss of export of the product and at least a single declaration of export to the United States of the exceptional purchase product, in January 2023.
Manufacturers who provide foods directly or indirectly to exporters should present cars -dislike loss in the export of the product subject to exceptional acquisition.
Government purchases of an exceptional character will be of the exclusive responsibility of the agency or extent of the Public Administration. Food should be intended for school feeding programs, armed forces, hospitals, among others. The ordinance comes into force on Friday.
