The legislation promoted by the Meloni government provides for the arrest for the irregular sharing of Deepfakes, regulates the supervised use of technology in health and work and limits access from children. The Parliament of Italy approved on Wednesday (17/09) a law that regulates the use of artificial intelligence (AI) in the country and establishes imprisonment for those who produce and share content generated irregularly from technology.
With approval, Italy becomes the first Member State of the European Union to define the rules in line with the European regulatory framework.
The rule presented by the government of Prime Minister Giorgia Meloni establishes the transparent and confident use of artificial intelligence as central principles, in line with requests for innovation, IT security and privacy protection.
The law introduces transversal rules that cover health, work, public administration, justice, education and sport, which require traceability and human supervision in the decisions taken with the use of technology.
Penalty for irregular use
Feathers have also been established for the irregular use of technology. For example, those who have spread the contents generated by artificial intelligence, such as the deep, who cause damage, can be punished within five years of prison. For example, the sharing of photos or videos created by artificial intelligence without permission is considered harmful. Illegal use will also lead to more serious penalties for crimes such as identity and fraud theft.
Legislators acted after having grown up in the country the sharing of intimate videos generated by artificial intelligence that women appear, mainly public figures.
Another point led by the European regulatory framework is the concern for copyright. According to the new Italian law, the works created with the help of AI are protected if they derive from intellectual effort.
The platforms can use text, images and online videos just to generate their content if the materials are not protected from copyright. It is also possible to access scientific research conducted by authorized institutions.
In health, the IA can be used to help in the diagnosis and treatment of some diseases in specific conditions. By law, the final decision should be of the doctor and the patients have the right to be informed about the use of technology.
In the workplace, employers should also inform their employees when the IA is used in internal automations.
Already less than 14 years old can have access to technology only if there is the consent of the managers.
“This law reports innovation to the public interest, directing the AI to growth, rights and full protection of citizens,” said Alessio Butti, undersecretary for Italian digital transformation.
Investment fund
The Government has designated the Agency for Digital Italy and the National CyberRSecurity Agency as National Authorities for the development of artificial intelligence.
A capital fund at risk of up to 1 billion euros supported by the State can be created for investments in companies (small, medium or large) that act with AI, IT security, quantum technologies and telecommunications.
Critics have declared that the resources made available are tiny compared to international initiatives.
