Core 4 of the coup plot is condemned by the 1st Panel of the STF

The First Panel of the Federal Supreme Court (STF) concluded the trial this Tuesday (21) October and ordered the conviction of the seven defendants of nucleus 4 of the coup plot. The group was accused of spreading false information with the aim of generating institutional instability and encouraging a coup attempt in the country.




According to investigations conducted by the Attorney General’s Office (PGR), the defendants used the structure of the Brazilian Intelligence Agency (Abin) to spy on political opponents. The actions also included the creation and dissemination of false data that aimed to undermine the credibility of the electoral process, democratic institutions and authorities that posed obstacles to destabilization interests.

The agreement of the majority within the Panel was consolidated by the minister’s vote CarmenLucia. The five-member commission followed the position of the rapporteur, Minister Alexandre de Moraes, to sentence the seven defendants for five categories of crimes. The criminal classifications applied were: attempted violent abolition of the democratic rule of law, coup d’état, armed criminal organization, qualified damage and deterioration of encumbered property.

In addition to ministers Alexandre de Moraes and Cármen Lúcia, the ministers Cristiano Zanin AND Flavio Dino. The minister Luiz Fux he expressed dissent in the trial, which totaled 4 votes in favor of conviction and 1 vote against. Ministers are now analyzing the dosimetry of the fine.

In her statement during the vote, Minister Cármen Lúcia commented on the political system and freedom of expression, mentioning the relationship between trust and political regimes. Regarding the facts of the case, the minister highlighted the evidence of the crimes, stating that: “Both the crimes of an armed criminal organization and the crimes of attempting to abolish a coup were characterized by proven criminal practices.” It further added that the evidence was abundant regarding the materiality of the crimes of qualified damage and deterioration of encumbered property.

The convicts who make up nucleus 4 are: Ailton Moraes Barrosformer Army major; Angelo DenicoliArmy Reserve Major; Carlos Cesar Moretzsohn Rochapresident of the Voto Legal Institute; Giancarlo RodriguesArmy Warrant Officer; Guilherme AlmeidaArmy lieutenant colonel; Marcelo Bormevetfederal police officer; AND Reginaldo AbreuArmy colonel.
