Braga delays small consumers’ access to the free energy market by a year


According to the government’s proposal, starting from August 2026 there would be freedom of access to a wider range of consumers linked to industry and commerce, with the opening to the entire market, including the residential one, from December 2027

BRASILIA – The senator Eduardo Braga (MDB-AM) changed the calendar that allows low voltage energy consumers, small consumers, access to free electricity market. In this market, consumers will be able to choose their energy suppliers, accessing more convenient sources, and still paying a lower share of sectoral charges.

The government’s original proposal was that small consumer adoption in the commercial and industrial sector would begin next year. For residential properties, migration would be authorized for 2027.

The measurement would be a compensation, for the middle class, of the greater burden due to the payment of the social tariffwhich grants exemption from electricity bills to the lower income population.



Node report presented on TuesdayThe 28 Braga establishes a maximum deadline of 24 months for the adhesion of low voltage industrial and commercial consumers, starting from the approval of the standard.

For residential consumers, the migration must occur within 36 months, or three years.

In the free market, consumers are not limited to the local distributor. In practice, this modality allows the negotiation of prices and conditions directly with energy producers and traders, with potential cost reduction.

According to the government’s initial proposal, there would be freedom of access to a broader group of consumers related to industry and commerce from August 2026, with the entire consumer market, including residential, opening up from December 2027.

A point of attention in the report is the expected “until” and not “from” deadline for the market to open. It is also planned to implement a communication plan to raise consumer awareness regarding the option of migrating to the Free Trading Environment (ACL).
