The request is based on the video published by Bolsonaro who questioned the outcome of the presidential election. STF has yet to give authorization to investigate the former president.
The Attorney General’s Office (PGR) has asked the Supreme Federal Tribunal (STF) that former President Jair Bolsonaro (PL) be included as a target of one of the investigations investigating those responsible for the January 8 invasion of the Three Powers headquarters. The order was placed this Friday (13/1).
The thesis is that Bolsonaro would have publicly instigated the commission of crimes for having posted a video, on January 10, which questioned the result of the 2022 presidential election.
It is the first time that the PGR has officially asked to investigate Bolsonaro for anti-democratic acts.
The request made by the PGR refers to an investigation investigating the instigation and intellectual authorship of the invasion of Palazzo Planalto, the National Congress and the STF.
According to a statement released by the PGR, the head of the Strategic Group for Combating Undemocratic Acts, Carlos Frederico Santos, says that although the video was released after the invasion, Bolsonaro’s conduct must be investigated.
“There is no denying the existence of a probative link between the facts contained in the representation and the object of this investigation, which is more extensive. For this reason, the global investigation of the acts carried out before and after 8 January 2023 by the accused is justified”, reads an excerpt from the note.
In all there are at least seven inquiries opened by the PGR to investigate the invasion.
Bolsonaro’s alleged responsibility for the invasion of the Three Powers’ headquarters has been supported by politicians such as President Luiz Inácio Lula da Silva (PT). Shortly after the records filed in Brasilia, he claimed that Bolsonaro was responsible for the invasion.
“This genocide not only provoked this, not only stimulated it, but who knows, it’s still stimulating it through social networks, you know, that we know from Miami, where he went to rest,” Lula said alluding that Bolsonaro was in Florida since before the end of his term.
In response, Bolsonaro rebutted Lula’s allegations through a post on his social networks.
“[…] I repudiate the allegations, without evidence, attributed to me by the current head of the executive of Brazil,” Bolsonaro said.

The invasion
On Sunday afternoon, thousands of supporters of former President Jair Bolsonaro (PL), dissatisfied with the election of President Lula and in defense of agendas such as the closure of the National Congress, stormed the seat of the three powers of the Republic.
They arrived in Brasilia in recent days and occupied the Esplanada dos Ministérios, in the central area of the city, throughout the day.
The military police presence in the area failed to prevent the invasion. Order was restored hours later after police reinforcements arrived.
After the invasion, President Lula announced a federal intervention in public safety in the Federal District.
The executive secretary of the Ministry of Justice, Ricardo Capelli, was appointed to intervene and will lead the security apparatus of the Federal District until the end of January.
Hours later, the minister of the STF, Alexandre de Moraes, temporarily removed the governor of the Federal District, Ibaneis Rocha (MDB). The position was now held by the lieutenant governor, Celina Leão (PP).

On Tuesday (10/1), Alexandre de Moraes issued an arrest warrant against Torres, who is on his way to the United States.
The arrest was based on the thesis that, as public safety officer in the Federal District, Torres had committed a willful omission by allowing Sunday’s events to take place. Through his social networks, Torres has declared that he will return to Brazil in the coming days.
On Thursday, newspapers such as Folha de S. Paulo and O Globo reported that the PF had found a draft from Bolsonaro’s time as Justice Minister of a decree to impose a state of defense that would allow the result of the presidential election to be reviewed from 2022.
Via his social media, Torres claimed that the disclosure of the draft took place out of context and that the document would be discarded.
“There was a stack of documents in my house to be disposed of, where the material described in the report was most likely found. All would be taken to shredding in due course at the MJSP. The said document was withdrawn when I was not present, and leaked out of context, helping to fuel fallacious narratives against me. We were the first ministry to deliver management reports for the transition. I respect Brazilian democracy. I have a clear conscience regarding my performance as a minister,” Torres said.
