Lewandowski rejects habeas corpus of coup prisoners in Brasilia

Minister Ricardo Lewandowski, of the Federal Supreme Court (STF), rejected two habeas corpus (freedom requests) of two people arrested for involvement in acts of state in Brasilia on 8 January. The defenses have asked for the revocation of the arrests decided by the minister Alexandre de Moraes.

Lewandowski cited the established interpretation of the Court, according to which it is not possible to prosecute habeas corpus against an act of a collegiate body of the Court or of any minister.

The minister is also the speaker of an action proposed by the lawyer Carlos Alexandre Klomfahs who asks for “safe conduct” to former president Jair Bolsonaro (PL) and former secretary of public security of the Federal District (DF), Anderson Torres. Bolsonaro is being investigated for acts of instigation and Torres for not having commanded the security forces that day.

Klomfahs is the same lawyer who filed a writ of habeas corpus in the Superior Military Court (STM) to release the detainees after the January 8 proceedings. The request has been rejected.
