Values for guaranteeing numbers in front reach R$500; the sale may incur a crime against the consumer, with imprisonment from 6 months to 2 years and a fine
the concerts of The Tour of the Agesby the singer Taylor Swiftto the Brazil, have mobilized a multitude of fans. The number of connected devices in online sales queues exceed 900 thousand.
This Thursday 22, at 10 am, general sales begin for the extra shows announced after the high demand for tickets. In overall sales for previously announced shows, the number of devices that won a spot for a chance to see the artist up close exceeded 1.6 billion.
The criminals took advantage of the success of the The Tour of the Ages practice the exchange, an illegal practice which involves the resale of tickets at prices higher than the initial value. On illegal sites, prices reach R $ 5 thousand. Cases made procon and the Civil police carried out a joint operation that arrested between 20 and 30 money changers in St. Paul.
Now, however, new practices are starting to crop up, this time online. During the pre-sale of the extra shows, which took place on Monday 19th, it was not difficult to find people announcing a good number of seats in line on the official website of the tour for sale. The values reach R $ 500.
Second Marco Chaves, a lawyer specializing in digital law, the practice of selling a seat in line is not in itself a crime. The problem is that tickets pass with the added value of a place in the queue.
“Especially in virtual queues – as the process of occupying a seat does not allow you to transfer it to someone else – in order for the transaction to be completed, you need to buy the ticket and then sell it with the added value”, explains Chaves. During the pre-sale phase, some Internet users even asked for the number of the C6 Bank Mastercard card, necessary to access the site.
the criminal lawyer Diogo Tebet reiterates that there is no offense in criminal law called trading. However, “it may be considered a possible crime against the popular economy to try to make ill-gotten gains from people through speculation or fraudulent processes (it should be understood that selling a queue seat would be considered a fraudulent process).”
The penalty is imprisonment from 6 months to 2 years and a fine, according to the lawyers. Faced with this practice, it is important to report it both through the official sales channels and to the police authorities: local Procon, the Civil Police and the Public Prosecutor.
The ideal, as Marcos Chaves says, would be both to create reporting channels, especially anonymous ones, and to monitor the practice on social networks. “Ticket sales platforms must inform, in terms of use and through notices – disclaimers – the prohibited actions and the consequences of the practice,” he says.
Diogo suggests implementing a facial or digital recognition system at major events. “However one cannot lose sight of the fact that admission can become more expensive due to the structure involved,” he concludes.
OR Stadium contacted T4F, the responsible manufacturing company The Tour of the Ages in Brazil, questioning whether the company was aware of the cases and plans to take steps to avoid the practice during sales on Thursday, but has not received a response as of publishing.
