Leo and Carmelo Maia are children of the same mother, Maria de Jesus Gomes da Silva, known as Geisa, but only the second is the son of Tim Maia

The court of Sao Paulo convicted the singer Leo Maia compensate his half-brother, Carmelo Maiasole heir of Tim Maia (1942-1998), prohibiting him from continuing the project Tim Maia for children.

The court ordered a payment of R$35,000 for each show held since 2019 and compensation for moral damages of R$10,000. The total amount of compensation will also be calculated.

Leo and Carmelo are brothers on their mother’s side, Maria de Jesus Gomes da Silva, la Geisabut only the second is Tim Maia’s son and holds the economic rights to his work.

The case was opened in 2019, with the accusation that the half-brother would have used, without authorization, Tim Maia’s fame and prestige to obtain financial returns.

“He lightly proclaims himself as the son of Tim Maia and misappropriates his name, his image and his works,” he told the court.

Leo defended himself in court by stating that he was Tim Maia’s socio-emotional son and that “he was raised as such since he was still in his mother’s womb”.

The musician also stated that in his career of more than twenty years he has appeared in several television programs and that during this period his physical resemblance to Tim Maia has always been highlighted, as has his voice.

“Leo Maia has always been linked to the figure of Tim Maia,” lawyers Diego Peradin and Bruno Arminio, who represent him, told the court. “If following the same career wasn’t enough, he is committed to passing on his father’s legacy to the next generation.”

Lawyers have asked for the compensation process to be suspended until the final ruling in an ongoing paternity investigation in Rio de Janeiro courts. At first instance Leo had already lost: the Rio Court held that it had not been proven that Tim Maia had an affectionate paternal bond with Leo.

In the decision with which he sentenced Leo Maia, at the court of São Paulo, judge João Pazine Neto, rapporteur of the case, stated that his conduct was classified as illegal due to the unauthorized commercial use of the name and image by Tim Maia. Leo Maia can still appeal.
