Justice denies the exhumation of Gal Costa and the case is forwarded to the police


The request for exhumation was made by Gabriel Costa, the singer’s only son, who also requests the transfer of the body to a cemetery in Rio.

The Sao Paulo court has denied the exhumation of the body of Gal Costa (1945-2022), at the request of the singer’s only son, Gabriel Costa. The information was made available this Wednesday (4/10) in the Diário da Justiça.

The Public Records Court, which analyzed the young man’s application, said it did not have the administrative and registration authority to analyze the case. The judge forwarded the case to the police through the CIPP (Police Investigation and Trial Centre) to investigate a possible crime committed by Petrillo.

“The issue raised by the appellant is not only a matter of news, but also of criminal news. The facts narrated suggest the commission of a crime against Mrs. Gal Maria da Graça Penna Burgos Costa”, we read in the decision of the Court of São Paulo .

Decree nº 16.017/80, which deals with the topic, also establishes that “outside the established terms […]the exhumation of corpses may be authorized in advance by the state health authority in cases of proven public interest, as well as in cases of request from the judicial or police authority to carry out investigations”.

Request for exhumation

Recently Gabriel Costa requested authorization for the artist’s body to be exhumed and subjected to an autopsy to validate the death certificate. The heir says that, the day before his death, his mother appeared to be in good health. The petition states that Wilma Petrillo, Gal’s widow, prohibited “any autopsy” to obtain further information and ordered burial in a restricted-access grave.

In addition to the requests, the heir requests that Gal Costa’s remains be transferred to the São João Batista cemetery, in Rio de Janeiro, where the artist purchased a tomb to be buried next to her mother, to whom she was very close.

At the time of his death, Gabriel Costa was a minor and could not interfere in the decision. The 18-year-old also disputes in court the declarations according to which Petrillo was Gal Costa’s wife and the portion of the assets she claimed.
