The composer requests investigations into possible falsification of the power of attorney presented in a plagiarism case
The criminal complaint highlights irregularities in the document
Composer Toninho Geraes has filed a criminal complaint requesting the opening of a police investigation to investigate the alleged falsification of documents presented by Adele’s defense in the legal case relating to the song “Million Years Ago”. According to Geraes’ lawyers, the tampering would have occurred in the power of attorney which authorized the singer’s legal representation in the event that the Brazilian composer claims plagiarism.
The dispute began in February, when Geraes sued Adele over similarities between “Million Years Ago” and “Mulheres,” popularized with Martinho da Vila’s vocals.
At the hearing held in December last year, the artist’s defense appointed a legal representative who, according to the complaint, had no power of attorney during the meeting. The document was presented later but, according to the prosecution, showed signs of erasure.
Accusations of forgery and procedural fraud
The criminal complaint points out that the power of attorney contains terms in English and Portuguese without sworn translation and presents conflicting information.
One of the highlights is the supposed location of the signing: Sao Paulo, a city where Adele has never been. Furthermore, the singer’s signature on the document would be different from others publicly available.
If the falsification is proven, the interested parties can be held accountable for falsification of documents, ideological falsification, use of a false document and procedural fraud.
Court decision and appeal
In December, the Rio de Janeiro court ordered that the song “Million Years Ago” be removed from streaming platforms and prohibited from being sold without Geraes’ authorization, under penalty of a fine of R$50,000.
However, the record company appealed and the song remains available.
No response from the record companies
When contacted, Sony Music, Adele’s representative in Brazil, and Universal Music did not comment on the new chapter in the case. The space remains open for statements and updates.
