Singer and heirs of Erasmo Carlos trigger the Supreme to try to review old contracts signed with Brazilian label
ROBERTO CARLOS and the heirs of Erasmo Carlosdeceased in 2022, they called the court. The goal is to try to rediscuss old contracts signed between the 1960s and 1980s with the label Fermata do Brasil.
The issue is considered complex and still without a consensus in the national legal scenario. Now it is in the hands of Supreme Federal Court (STF).
According to Rayssa Mottacolumnist for EstadãoRoberto and the heirs of Erasmus claim that the old contracts foresaw only “The commercial exploration of recorded songs in material support, such as vinyls, CDs and DVDs”. Thus, they try to review the agreements thinking about the new conjuncture of the music industry, based mainly by streaming.
THE Fermatein turn, argues that “The assignment of rights was definitive at the time of signing the contracts and values for all formats, existing at the time or not”.

The legal imbroglio is already circulating in the corridors and in the plenary of the Supreme Court. The rapporteur of the process is the minister Toffoli Dayswhich, according to the column, recommended that the theme be debated on a “general repercussion”.
This means that from the action brought by Roberto Carlos and the heirs of Erasmus, considered relevant in the current scenario, the Supreme Court may apply the same understanding to other similar cases.
Minister Toffoli advocated on the subject (transcreation via Estadão):
“Considering the new digital economy and the constant challenges it created, the question posed in these records must be faced from the constitutional perspective, not only for the orientation of the system as a whole, but also to have legal certainty in contractual relations and the entertainment market.”
The process is still with the rapporteur and should be included in a second semester voting agenda, says Rayssa Motta.
