Top Gun 3 : The lights are green
The runway for Top Gun 3 emerges, with a court decision that will give a free hand to the producers of the new film starring Tom Cruise. In fact, after the great success of Top Gun: nonconformistthe widow and son of journalist Ehud Yonay, whose 1983 article “Top Guns” inspired the 1986 film, had filed a copyright infringement complaint.
Reminder of the facts: Paramount studios purchased the rights to adapt the article in 1983, for a period of 35 years. Top Gun: nonconformist having been released after the expiration date of those rights – but partly produced during this legal period -, and the studios having not renewed the purchase of the rights, the Yonay family then took legal action in June 2022 to rule on a possible violation of these rights the copyright agreement.
Justice rejects the complaint against Paramount
In a recent decision, Judge Percy Anderson found this out Top Gun: nonconformist had not broken the rules and that, despite being a sequel to the original work, it was only very distantly related to the 1983 article. Paramount welcomed the decision via a statement:
We are pleased that the Court recognized that the plaintiffs’ claims were without merit.
Several experts have argued to what extent the true story of Ehud Yonay’s article can be retrospectively considered the origin of the fiction developed by Paramount Studios. In fact, a “true” story, with real people and the account of real words, cannot fall within the copyright protection regime. But without the publication of this true story, there would never have been the creation of a (fictional) “Top Gun” universe.
The Yonay family’s attorney said they will appeal Judge Anderson’s decision. But it seems that the merits of the case have been definitively judged, and that Paramount Studios now has completely clear skies to develop the new Maverick adventure.
