Apparently Marshall Jefferson’s hit song “Move Your Body” was included in the 45-year-old song “Flowers” without permission. Jefferson’s editor at Ultra International Music Publishing filed a complaint and condemned Kanye West’s “hypocrisy”, saying in part:
West defends the rights of artists with one hand, but does not hesitate to take away the rights of another artist with the other.
Additionally, they claim that the Grammy winner and his reps have admitted sampling without authorization in previous chats. They testify that it was therefore a “deliberate” attack and “in flagrant violation of the property rights of the UIMP”. Marshall Jefferson, 62, said in a personal statement to the outlet:
I’ve been sampled thousands of times. There is a right and a wrong way to do it. That it is done by another artist, a BLACK artist, a Chicago colleague with no recognition is disappointing.
Therefore, the UIMP is asking for a “permanent injunction” against Kanye West and others not to continue using the sample in question.
