A father seeks financial compensation of more than US$2.3 million (approximately R$10 million) against his ex-wife. The reason? While driving her, he collided with a truck, resulting in the deaths of her and their four children in the car.
James McLeod, Charmaine McLeod’s ex-husband and father of their four children, who were aged between 2 and 6, filed a lawsuit against her, on charges of intentionally causing the accident by diverting his vehicle into the path of a truck in 2019. The information comes from the Australian website Kidspot this week.
The incident occurred in the South Burnett region of Queensland, Australia. In addition to their mother’s death, her children Aaleyn, 6, Matilda, 5, Wyatt, 4, and Zaidok, 2, were also killed.
An inquiry into the five deaths was completed in the Brisbane High Court last month. McLeod, who is a volunteer firefighter, filed a lawsuit in the Supreme Court against his late ex-wife’s estate and his insurer, Suncorp Insurance, in 2021.
In the indictment, he claims to be psychologically destroyed, unable to re-enter the job market and in need of constant care, resulting from the accident caused by the “heinous and reprehensible” behavior of his ex-wife.
According to court documents obtained by NCA NewsWire, McLeod alleges that Charmaine “intended to cause him psychological harm” or was “reckless” about the possibility of psychological harm resulting from the death or injury of her children.
“As the driver of the vehicle, the first defendant (Charmaine) had a duty to exercise reasonable care to avoid exposing the plaintiff (James), the father of her passengers, to the risk of psychological harm which could result if their children had been injured or killed in a collision,” reads an excerpt from the indictment.
The defense claims that the father suffers from post-traumatic stress disorder (PTSD) with associated anxiety and depression, adjustment disorder with depressed mood and alcoholism due to the loss of children. In addition to a number of problems such as low self-esteem, insomnia, flashbacks and nightmares of the event, travel anxiety, among others, as stated in the lawsuit.
McLeod started receiving a disability pension around 2020. He is now seeking $606,279.60 (roughly 3 million) to cover future economic losses, as well as $70,995.34 (roughly R$340,000) in retirement.
During the investigation, it was revealed that there was a note near the crash site on the Bunya Highway in South Burnett, Queensland, in which Charmaine, the mother of the children, said she could no longer take her own life. and was worried about the future of children.
Additionally, the mother was shown to claim hearing voices urging her to harm herself or her children, as well as mental health issues including schizophrenia and Charmaine’s personality disorder.
