Influencer Gessica Kayane Rocha de Vasconcelos, known as Gkay, has lost a lawsuit against the owners of a house she had rented in Granja Julieta, in the south of São Paulo.
In the action, GKay sought to recover a sum of R $ 108,000, which he paid as a deposit to the owners of the villa, and which was not returned when he left the property. The influencer said she moved to Rio de Janeiro shortly after closing the lease of her home in São Paulo and, for this reason, she broke the lease.
Through the lawyer Anna Carla Lopes Correia Lima de Freitas, GKay asked for the return of the deposit, which is equivalent to three months’ rent, claiming that “it had been transferred by her employer” to the capital of Rio de Janeiro and that the amount paid “cannot be withheld as a fine”.
The São Paulo judge disagrees with the claim and rejected the influencer’s request. In the decision, published last Wednesday, 8, Judge Guilherme Duran Depier, of the 10th Civil Court of the Court of Justice of São Paulo, stated that “there was a market proposal which, since the author was economically and professionally interesting , was accepted by it, for the provision of the service for a specific and short period of time. Now, by accepting the proposal in question, it is up to the plaintiff to bear the consequences of the contractual breach she intended, since this provision is not necessary for the provision of the services, also because it is not definitive “.
The judge ruled that GKay still has to pay 10% of the case value as legal fees for the homeowners. This percentage should be around R $ 10.8 thousand.
