A Civil police from Sao Paulo is investigating the case of death of the newborn Davi Panontin, just dead two days of lifeon July 3 of this year, al Santa Joana Hospital and Maternity, in the capital of São Paulo. The police investigation was opened a month after the boy’s death. The police are investigating the case manslaughter AND ideological falsehood.

The investigation, which Earth had access, cites a request from the Public Prosecutor’s Office and the complaint presented by Victor Melo, the father of the child. They say they believe there was negligence on the part of maternity workers in the care provided to the newborn. Furthermore, the hospital would have tried to “cover up the real cause of Davi’s death”, who was left asphyxiated after inhaling his own vomit.

Police asked the hospital for images from cameras operating in the NICU from the day of Davi’s birth until the day of his death, as well as images from the morgue or the place where the child was found dead .

Dr. Marília Panontin and her husband, Police Chief Victor Melo, reported the Hospital e Maternidade Santa Joana to the São Paulo Public Prosecutor’s Office for medical malpractice and fraud on death certificates. The information initially provided to the parents was that the child had died of cardiac arrest.

The mother, however, says she had access to the medical records, in which it would be written that the child had suffered “suffocation and regurgitation”, having aspirated “a large quantity of white milky-looking secretion”.

David died on July 3, two days after his birth. According to the mother, although he was premature – the baby was a twin and was born at 35 weeks of gestation, and the ideal is from 37 -, he came into the world healthy. He and his sister Lara were taken to the NICU, where they were expected to be monitored and gain weight.

The hospital specified, in a statement, that it could not provide details on the case for reasons of medical confidentiality, but that it had not detected “the failure to comply with treatment protocols”.

“Santa Joana Hospital and Maternity is a serious institution and has been dedicated to maternal and newborn health for more than 75 years. For reasons of medical confidentiality, it clarifies that it cannot share further details on the case. The treatment protocols and reiterates that it is a the provision of the competent authorities for a thorough investigation of the facts”, reads the full note.

Entities speak

In addition to the deputy, who opened proceedings to investigate the case, the regional councils of Medicine and Nursing also expressed their views on the case. To the Earththe Regional Council of Medicine of São Paulo (Cremesp) reported that it is investigating the case confidentially.

“The investigation follows the procedural terms established by the Code of Ethical-Professional Processes of the Federal Council of Medicine. Any further manifestation of the Council may result in the nullity of the process”, reads a note.

The São Paulo Regional Nursing Council (Coren-SP) said it had opened an investigation to investigate the “possible participation of nursing professionals” in the child’s death. The agency also said the investigation would be held in secrecy.

The Coren-SP also stated that if evidence of an ethics violation is found, a professional ethics trial will be initiated. Nurses involved in the case may be asked to present their version of events.

“The sanctions provided for by law 5.905/73, in case of confirmation of the infringement are: reprimand, fine, censure, temporary suspension of the professional practice or revocation of the professional practice by the Federal Council of Nurses”, concludes the body .
