Government notifies health plans for unilateral contract terminations; see list

The National Consumer Secretariat wants to know the profile of the customer concerned and the reason for the cancellations; the association states that “it is available to provide technical information”

After receiving a significant number of complaints about unilateral deletions of health insurance on the part of the operators, on Friday 24th, the National Consumer Secretariat (Senacon) warned 20 operators or bodies so that, within ten days, they can provide clarifications on this conduct.

They were informed:

  • National Unimed
  • Bradesco Saude
  • Amyl
  • South America
  • Notre Dame Intermedica
  • Porto Seguro Saude
  • Golden Cross
  • Hapvida
  • GEAP Health
  • Assefaz
  • Omin
  • A health
  • Prevent the elderly
  • So Cheers
  • MedSenior
  • CarePlus
  • Unidas – National Union of Healthcare Self-Management Bodies
  • FenaSaúde – National Federation of Supplementary Healthcare
  • Abramge – Brazilian Association of Health Plans
  • Ameplan – Association of Planned Medical Assistance

In a note Abramge informs that “he is available to provide technical information to clarify important points about health service workers and the regulations to which they are subject” (read more below).

Each operator received four questions:

  1. What was the number of unilateral contract cancellations/terminations carried out by the operator in 2023 and 2024?;
  2. What reasons justify these procedures?
  3. How many of these beneficiaries were in treatment, how many require treatment or ongoing health care, and how many are elderly or have pervasive developmental disorders?
  4. What is the age range of beneficiaries whose plan was cancelled?

“Senacon is committed to ensuring that healthcare providers respect the rights of consumers, ensuring transparency and safety. We are taking rigorous measures to ensure that these abuses are curbed and that the needs of beneficiaries are met with dignity and respect,” said the Secretary national consumer, Wadih Damous.

This Thursday, the Estadao It has emerged that thousands of health plan customers have received, in recent months, notifications of unilateral cancellation of their contract by their operators. In almost all cases the justification is that the customer portfolio in question is lacking and cannot be maintained by the company.

In addition to the significant number of complaints recorded in Senacon’s systems, the agency has also noted an increase in preliminary investigation notifications (NIPs) in the National Supplementary Health Agency (ANS) system.

In a statement, Abramge confirmed that he had received the notification and informed that he “is available to provide technical information to clarify important points about health service providers and the rules to which they are subject.” The institution also underlined “its institutional commitment in the search for sustainable access to integrative healthcare, which aims to offer efficient and quality care to the beneficiary”.
