According to family law attorney Mônica Paiva, a parenting plan is not the same as shared custody. “In shared custody, parents share decisions about their children’s lives, but obviously the parental project is possible only to the extent that the parties have shared custody. However, it is right to underline that other types of custody, such as unilateral custody , it is also possible to have a parental plan”, explains the lawyer.

How is parental planning done?

The first step in creating a parenting plan is deciding where the child will reside. Either with a father or mother, or with alternative accommodation. “This second option is not very common, since many see it as something harmful for children, since they constantly change the house in which they live and may not be able to establish a residence on their own,” adds Mônica.

From this first decision onwards, subsequent rules come into play, such as each parent’s birthday, holidays and trips. The lawyer also revealed that the parenting plan also decides whether the child cannot attend a place, what religion he or she should follow and which school he or she should be enrolled in. “It’s really a plan, but it can be revised at any time, especially since this child will grow up and parents may reconsider some decisions,” he emphasizes.

Since it concerns a minor child and his entire life, Mônica recommends that the entire process be approved by the Public Prosecutor. But the lawyer sees many couples doing this planning verbally or simply by signing in offices.

A parenting plan is your best bet to prevent post-divorce problems and confusion. “I see that it systematizes. Planning establishes a routine for this child, the goals that the parents have for him and how it will work. It is advantageous, because it makes him anticipate uncomfortable situations and establishes the role of each of the parents”, analyzes Mônica.
