How far would some parents go to fulfill their dream of conceiving a grandchild? A couple, whose identities have not been disclosed, have been fighting a legal battle in the UK to get permission freezing his son’s sperm, who was unconscious and under medical care, and fertilizing it in his girlfriend.
On October 24, the 22-year-old had a stroke while playing sports and was taken directly to intensive care at the hospital. As he remained unconscious and with no prospect of recovery, his parents requested an urgent hearing in the Court of Protection of England, which was granted by Judge Nigel Poole – after hours – on 3 November.
As stated in the report of the trial (published on the 16th), those responsible tried to prove it to the court the young man expressed the desire to have children. Evidence was presented through messaging apps and allegations that the boy kept his childhood toys so that he could one day give them to the child.
Furthermore, the parents confirmed that their son’s girlfriend had also expressed an interest in taking a conceived child with her. At the request of the family, the sperm would be collected by removing part of the testicles. The procedure had to be done quickly due to his fragile condition and the young man would neither notice the procedure nor suffer any pain.
Request denied
Despite the accusation of family members that semen collection was consistent with the boy’s desirethe parents’ claim was disputed by the National Health Service of England and Wales (NHS Trust) at the time of the hearing.
According to the organization, there would be court approval for the collection and storage of sperm, without royal consent violation of the law on human fertilization and embryologysince 1990.
The judge then denied the request. “There is no evidence whatsoever regarding X’s opinions and beliefs [o jovem]🇧🇷 It’s one thing to have a constant and sincere desire to be a lively and caring parent. It’s another thing to want your sperm collected and stored when you are unconscious, without having expressed any opinion in life about how sperm should be usedsaid Poole.
Furthermore, the magistrate concluded that there is no confirmation that he and his girlfriend were trying to get pregnant in the present or in the past, and that the the risks and benefits of the procedure should be evaluated.
“X’s semen collection process is physically invasive and there is no evidence that he would have consented or consented to its purpose. His right to privacy and self-determination regarding reproduction must be considered. There is no evidence before the court to convince me that X would have wanted his sperm collected and stored in his current circumstances.”
After the trial, Judge Poole was informed of the brain death of the young man, on 8 Novemberand offered condolences to the family in the final statement released.
