A House of Representatives approved this Monday 27, the Provisional Provision 1149/22, which attributes to the Federal Economic Caixa the administration, from 1 January to 31 December 2023, of the funds raised with the Insurance DPIVA, as well as the analysis of compensation claims and their payment. The PM will be sent to Senate.
The provision was approved with the favorable opinion of the substitute rapporteur Flavia Morais (PDT-GO), and without changes in the text. “This is a service which, due to market failures, could not be provided by the private sector without state intervention,” she said.
Created in 1974, the Compulsory Insurance for Personal Injuries Caused by Land Vehicles (DPVAT) compensates the victims of road accidents. The fund is fed by the annual payment of mandatory premiums by vehicle owners, but three years ago (from 2021 to 2023) the burden was suspended.
Last year, Caixa replaced Seguradora Líder in the role, through a contract with Superintendence of Private Insurance (Susep). The hiring, without an offer, is subject to questioning in the Federal Court.
The deputy legalizes the role of the bank in fund and insurance management. According to the government, the choice of Caixa derives from its size, capillarity and expertise in the most complex payment transactions.
Compensation
According to the approved text, the bank will continue to receive the contractual remuneration established at the time of the issuance of the MP until the National Council of Private Insurances (CNSP) defines the value of the remuneration for the service, after a proposal presented by Caixa.
The use of the digital social savings account is also authorized for people who receive the DPIVA compensations granted and relating to claims that occurred between 1 January and 31 December 2023. / PRESS AGENCY ROOM
