Into the Storm airs tonight on Arte, directed by the great Wolfgang Petersen and starring George Clooney, Mark Wahlberg, John Reilly and William Fichtner. Except that the film will be the subject of a lengthy lawsuit. But why ?
The plot of the film is simple: Captain Billy Tyne has a bad fishing season and decides to go to a cape full of fish. Except the elements won’t let him do it easily.
And very soon after the film’s release, the two daughters and wife of the real Captain Tyne, the character played by George Clooney, file a complaint v. Warner Studio. And the conflict will last fourteen years.

Jodie Tyne particularly criticizes the screenwriters for changing the facts of her husband’s life to make them more commercially attractive for the purposes of the film. According to him, Billy “Skip” Tyne was not the brawler that the film made him out to be, let alone the one who mocked his group.
Moreover, she claims that her husband would never have risked the lives of the entire group to safely transport the cargo when an unprecedented storm threatened.

She is filing the lawsuit in Florida, whose law protects people from misrepresenting someone in order to promote a product or commercial venture. Given that this is the case in Into the Storm, Jodi and her daughters are seeking financial compensation.
It didn’t take long to get a response from Warner, who responded that America’s First Amendment freedom of expression, since the film is officially based on the life of Captain Tyne, but with the addition of a piece of fiction, the Constitution protects Mid-Storm against this lawsuit.
Fourteen years of pending litigation resulted in a lawsuit before the Florida Supreme Court. This one, by a vote of 6 to 1, gives the basis to Warner Studio on June 7, 2014.
