Marco Civil from the Internet: STF postpones the judgment and paves the way for the House vote on Fake News PL

The Federal Tribunal (STF) has decided to postpone the judgment on the Civil Rights Framework for the Internet scheduled for this Wednesday 17. The president of the Tribunal, Minister Rosa Weber, will reschedule the analysis of the topic for the second half of June. There is no set date yet.

With this, the Chamber of Deputies gains more time to discuss and vote on the bill (PL) 2630/2020, which has come to be known as Fake News PL. The proposal establishes the Brazilian law of freedom, responsibility and transparency on the Internet. The sentence in the STF could trample the debate on the subject by the deputies.

Today, four actions in the STF discuss the regulation of social networks. Two of them deal with article 19 of the Marco Civil da Internet (law 12.965/2014), which establishes that big tech companies – such as Google, Meta (owner of Instagram and Facebook) and TikTok – can only be held responsible for third-party content if they do not take action pursuant to a court order. The other two wonder whether messaging apps – such as Telegram and WhatsApp – could be suspended if they do not comply with a court decision.

One of the lawsuits is based on the case of a woman who created a fake Facebook profile without her consent. The fake user has offended family members and acquaintances of the author. Even after being prompted, the social network did not delete the page.

The decision to adjourn judgment on these appeals was taken at the request of the rapporteurs. In addition to Rosa Weber, the topics are reported by ministers Edson Fachin, Dias Toffoli and Luiz Fux.

Already in the Chamber, the leaders of the parties articulate the analysis this Wednesday of two excerpts from the Fake News PL. The deputies cut the main text and removed for bill 2370/2019, by the rapporteur of deputy Elmar Nascimento (União Brasil-BA), the articles dealing with the payment of royalties to artists and the remuneration of journalistic companies by great technicians.
