Opposition and ruralists celebrate Marco Temporal PL, and government allies bet on the Senate and STF

The next point of concern for environmentalists and agribusinesses is the vote on the constitutionality of the project in the Federal Supreme Court, on June 7

The approval of Time Frame Bill imposed a defeat on the president Luiz Inácio Lula da Silvawith the support of the base in Room, and led the opposition to celebrate the setback suffered by the PT. The allies of the government, amid regrets, are now betting on the Senate and not Federal Court of Justice (STF) to reverse government failure.

The proposal that delimits until 1988, the year of entry into force of the d Constitution, the delimitation of indigenous lands received the approval of 283 deputies, including 98 from parties with space on the Esplanada dos Ministérios. There were 155 votes against and one abstention.

The President of the Chamber, Rodrigo Pacheco (PSD-MG), received this Tuesday 30, the Minister of Indigenous Peoples, Sonia Guajajara. Next to the deputy Celia Xakriaba (PSOL-MG), Guajajara tried to encourage Lula’s supporters: “The proposal will now go to the Senate, and we are still waiting for the vote on the timing in the STF,” he said. Célia, on the other hand, tried to minimize the vote in the Chamber: “We don’t feel defeated”.

A message, however, reached the court a week early. Before the vote, the Speaker of the Chamber, Arthur Lira (PP-AL), sends signals to the Judiciary: “The fact is that the Supreme Court will judge on 7 (on June)and this Congress must demonstrate that it is addressing this issue responsibly,” he said. As soon as the ruling was placed on the agenda, the House, with the support of the Agricultural parliamentary front (FPA) and allies of Jair Bolsonaro (PL), rushed to anticipate the ministers.

The president of the FPA, deputy Pedro Lupio (PP-PR), he celebrated: “The project will clarify the conditions for the demarcation of indigenous lands, it will clarify the issue of timing, it will make the right to property and legal security prevail in our country”, he said. On Twitter he posted the moment Lira announced the result.

The agri-food entities ask the Supreme Court for prudence. “This vote has done justice to both the indigenous people and the population. We hope that the STF sees that social justice is being done,” said the vice president of the Mato Grosso State (Aprosoja) Soybean and Corn Producers Association, Luca Beber. For him, the temporal framework respects the Constitution, because it does not prohibit new demarcations, but only establishes a new criterion.

Already Paolo Sergio Aguiar, vice president of the Brazilian Association of Cotton Producers (Abrapa), hopes that the ministers understand the message launched by the Congress. “It is a sign of the vision of the Parliament, which represents the population as a whole. I believe this will help the decision-making process of the STF,” said Aguiar.

Bolsonaro’s former agriculture minister, senator Theresa Christina (PP-MS) said the time frame provides “peace in the countryside”. “It is important that Congress fulfills its role of legislating relevant issues that bring justice and peace to the land, both for indigenous peoples and rural producers,” she said, on a social network.

Expectations in the Senate

A Articulation of the indigenous peoples of Brazil (Apib) foresees new articulations in the Senate. “Our resistance and strategy against PL 490 continues in the Senate. The defense of the Constitution will be done by the STF, which must judge in time,” the body said. If the Supreme Court rules that the issue is entirely unconstitutional, the House vote can be overturned.

Another minister defeated in the House is Marina Silva, from the folder Environment and climate change. He called the vote “an unacceptable injustice against Brazil’s indigenous peoples”. Through social media, she said she reaffirmed her “commitment to fight and work so that the constitutional rights of all Brazilian men and women are guaranteed”.

Head of Government in Congress, Randolph Rodriguez (No party-AP), said a pledge was signed to “thoroughly” appreciate the PL in the Senate, in response to the urgent regime the House approved for drafting the project. “We will not be overwhelmed in the Senate! The subject will be treated with the necessary prudence and due respect,” said the senator.
