The right-back has had a new request to respond to bail denied this month; according to the Spanish press, the investigation into the case has been completed
Accused of rape in a Barcelona nightclub, Daniele Alves complete five months in prison this Tuesday June 20th. Called up by Tite for the World Cup in Qatar, the right-back has had his life transformed since January 20, when the Spanish court decreed that the athlete be investigated and respond to the trial in preventive arrest.
With the contract terminated at Pumas and close to separating from Joana Sanz, the team was denied a request to respond to the trial in June in freedom. Furthermore, according to the Spanish press, the date of the trial has already been set: between October and November of this year. January
The case had its first repercussions in the Spanish press in 2022. On December 31, the ABC newspaper revealed that Daniel Alves had sexually assaulted a young woman at the Sutton nightclub the day before. The woman was always accompanied by friends and the nightclub’s security team called the Catalan police (Mossos d’Esquadra), who took a statement from the victim.
On January 10, the Spanish justice accepted the complaint and began investigating the player. The inconsistencies in the versions provided by the player to justice, as well as the possibility of fleeing Spain, led the judge Maria Concepción Canton Martín to order the arrest of Daniel Alves on Friday 20 January, after giving testimony.
The Investigative Court 15 of Barcelona is conducting the investigation. In contradictions, Daniel Alves also said that I did not know the woman who accused him; later, he revealed that there had been sexual intercourse, but in a consensual way. The request for the athlete’s arrest by the Public Prosecutor also took place due to the possible risk that he had “fled” from Spain, in the middle of the trial.
Daniel Alves voluntarily made a statement to the police, without his lawyers being present. The outsider was in Spain with Joana Sanz, wife and model, due to the awakening of her mother-in-law. In January, he even asked the press to respect his privacy during this time.

February
Dinorah Santana, first wife of Daniel Alves, his agent and mother of his two children, took sides in defense of the player, who was provisionally arrested in Barcelona while answering to a sexual crime charge. In an interview with the Spanish newspaper Sport, the Brazilian said she believed in the athlete’s innocence, despite the Spanish lawsuits.
Daniel Alves’ defense tried to appeal, with the deputy, for the player to respond to the trial in freedom. In a session held behind closed doors, the agency cited multiple evidence that would have incriminated the Brazilian, particularly DNA evidence, to deny the request.
In the midst of the trial, Daniel tried to maintain his relationship with Joana Sanz. On several occasions, the party called his wife to preserve the marriage. She also visited him in prison during this time. In one of the dialogues, revealed by the Spanish channel Telecinco, the player allegedly declared that he was drunk and did not remember anything that happened there.
March
Two months after being arrested, Daniel Alves was, according to friends and sources close to the player, depressed and hopeless. Added to this is the fact that, in March, Joana Sanz indicated that she would part ways with the player. In an autographed letter published on social media, the model says that she will continue to love him, but she needed to get away.
“I love him and will always love him. Anyone who says a love has been forgotten is either deluding himself or hasn’t truly loved. I am near a phase in my life that began on May 18, 2015. I am grateful for the opportunities and lessons life offers me. No matter how difficult it may be, here is a strong woman moving into the next phase of her life,” she wrote Joanna.
In the same month Daniele writes another letter, obtained exclusively from Stadium. In it, the player speaks directly to the woman and “regrets her decision”. In one of the excerpts, she writes about her innocence. “I understand the pain that the unfair situation we are experiencing is causing. I understand that you have not been able to resist all these pressures. The facts of which I am accused are foreign to me and to the values that have guided me throughout my life: love, respect and effort.”
Also, this month, according to the Spanish website El Caso, Brians 2 officials noticed a large amount of Barcelona shirts entering the penitentiary. The parts would be intended for an inmate who is allowed to circulate in different modules of the complex. The presence of the player triggers a plan to sell shirts autographed by the Brazilian, which are exchanged for packs of cigarettes.
April and May
Before completing four months in prison this Saturday, Daniel Alves returned to testify before Spanish justice in April. According to Spanish legislation, a person, as a suspect, can testify as many times as he deems necessary during the judicial process. That’s why Daniel asked to speak again.
In this new statement, he again reiterated that the victim had consented to sexual intercourse. Furthermore, he claimed that the multiple versions he offered on the case were a way to hide his infidelity on her from Joana Sanz. Also indicating that she would be parting ways with the player, the model continued with visits to the prison and she even congratulated him on her birthday in April.
According to a colleague of Daniel Alves, the Brazilian player is harassed in prison. Referred to as a “rapist,” he is often intimidated when he shares space with other inmates, such as during soccer matches and in the cafeteria. The identity of the fellow right-back has not been revealed.
The man also reveals that Daniel Alves is thinner and more depressed since arriving in prison. According to him, the Brazilian has privileges in prison, but did not specify which ones. The athlete spends most of his time isolated in his form and denies having sexually assaulted the 23-year-old who accuses him.
The defense has also requested a new release request for Daniel Alves. According to the player’s lawyers, there is no risk of flight for the defendant. His family, his ex-wife and his children have moved to Barcelona. The legal body says it always had plans for the two children to complete their university studies in Spain. For this they have come to live in the European country to live in the house they own in Esplugues de Llobregat, in Barcelona.
Furthermore, in the request sent on May 16, the defense points out that in the “recorded images two adults are clearly seen playing an erotic game before coitus”. This excerpt is present in the appeal, presented to the Court of Barcelona and disclosed by Oh. The appeal was rejected.
June
In another attempt to freely respond to the lawsuit, Daniel Alves was denied his plea last week. The new appeal by the Brazilian footballer’s defense used the presence of his children and ex-wife, who now reside in Spain, in an attempt to demonstrate to the Catalan Public Prosecutor that he has no intention of leaving the country before a possible trial to clarify the case.
It was pronounced by the player’s defense on the 9th and the answer came out on Monday the 12th, showing that the Barcelona justice treats the case as zero tolerance. In the same week, he claimed that only two people know what, in fact, happened at the Sutton nightclub on December 30: he and the complainant. “Only two people know what happened and, above all, what didn’t happen; I’m telling the truth,” said the player through his lawyer and published by the Spanish portal Servimedia.
Also, according to the Spanish newspaper The Periodical, the investigation into the case has already been concluded and the player’s trial will take place between October and November of this year. Unless the defense or prosecution requests or performs any type of testing, which is very unlikely, Daniel Alves faces the jury in late 2023.
What could be the penalty for Daniel Alves?
There is still no date for the verdict in the case of Daniel Alves in the Spanish justice, but it should still take place in 2023. In October 2022, the Spanish penal code was amended with the addition of a new law, which provides that sexual crimes should be classified on the basis of the consent of the victim. Called “Only yes is yes,” she began to consider all non-consensual sexual acts now considered violence. The player’s prison is maintained until the end of the trial.
According to the newspaper El Mundo, Daniel Alves could be sentenced to eight to ten years in prison.
