Eletrobras has a favorable decision in the STJ action regarding delays in the Chesf transmission line

Eletrobras informed that the 1st Panel of the Superior Court of Justice (STJ) has upheld an appeal filed by its subsidiary Chesf to annul a decision of the Court of Justice of the Federal District (TJDFT) unfavorable to the company in a case related to the delay in delivery of a transmission line.

In the lawsuit, Energia Potiguar Geradora Eólica and others argue that the alleged delay in delivery of the Chesf line would have damaged the flow of energy through its wind farms, causing losses.

Chesf was convicted at first instance in this case in 2019, but managed to overturn the decision by appealing. In 2021, however, the 5th Civil Panel of the TJDFT overturned the ruling in Chesf’s favor, and subsequently reaffirmed its decision in a reevaluation of the case last year.

“The decision issued on this date therefore determined a new judgment of the trial in second instance of the second requests for clarification then presented by the aforementioned appellants”, said Eletrobras, in a statement released on Tuesday evening.

The process is classified as a probable risk of loss, with an estimated value of 636 million reais, in Eletrobras’ balance sheet for the second quarter of this year.
