The Moro cassation is ready for the trial in the plenary of the TSE

Minister Floriano de Azevedo Marques has released for judgment in the plenary session of the Superior Electoral Court (TSE) the resources that will define the future of the mandate of Senator Sérgio Moro (União Brasil-PR). The transfer occurs one week after the process was distributed to his office. The president of the TSE, minister Alexandre de Moraes, has reserved the sessions of 16 and 21 May for the trial. He will leave the presidency of the court on June 3.

The appeals were presented by PT and PL and will be judged jointly. The parties are trying to overturn the decision of the Regional Electoral Tribunal of Paraná (TRE-PR) which acquitted the senator of charges of abuse of economic power in the 2022 elections.

The TSE has the power to re-analyse the evidence from the trial, which could lead ministers to decide against the Paraná Electoral Tribunal. The General Electoral Prosecutor’s Office (PGE) expressed its opinion in favor of maintaining the sentence, which reduces the pressure on the senator and former judge Lava Jato.

ACTIONS

Moro is responsible for abuse of economic power, illicit fundraising and improper use of the media in the 2022 elections. He denies irregularities. The backdrop is his frustrated pre-candidacy for president. The TSE will have to decide whether the expenses incurred during the period left the former judge in an unequal position compared to his competitors in the Senate.

One of the key points of the experimentation is the parameter that will be used to calculate the campaign expenses. The definition of what expenditures would or would not be pre-campaign, to assess whether or not there was an imbalance in the election, is controversial. The criterion divided the judges of Paraná.

The nature of the spending will also influence the vote. Ministers must decide whether expenditure that is not directly related to campaigning for votes is electoral in nature or not. This is the case, for example, of the amounts paid for personal security and escort. Another open point is whether expenses outside Paraná, in the pre-presidential campaign, should be included in the amount.
