Marcius Melhem is prohibited from leaking Dani Calabresa’s private conversations

The former director of the Globe Marcius Melhem has been forbidden by the Justice to leak to journalists or on his social networks the private conversations he had with the comedian Dani Calabresa, who accuses him of moral and sexual harassment during the period in which he was head of the Department of Humor at the Globe. The decision was made by the Foro Regional da Lapa, of the TJ-SP (Court of Justice of Sao Paulo), which judges one of the causes in the legal battle between the artists.

The precautionary measure was initially issued in November 2021, following a request from the defense of Dani Calabresa. The argument was that the leak was selective and violated the comedian’s privacy at the time. Justice agreed at the time that it was a violation and added nothing to the case.

On the 4th, justice rejected Melhem’s request to lift the ban. Despite this, the messages leaked to a columnist who covers television, producing several articles in the press.

If it is proven that the comedian or his defense relayed the conversations to a third party, Melhem could be punished, along with whoever made this undue leak, as the decision concealed the messages from the courts.

It has always been Marcius Melhem’s desire for these messages to be made public, especially in the period between 2017 and 2018, in which he claims to have had a consensual relationship with Dani Calabresa. The artist accuses him of having boycotted her on Globo since 2019 and of having taken her without his consent at a party with the former Zorra (2015-2020), in 2017. According to the accusation, Melhem would have tried to force the comedian to having oral sex with him in a bar corridor.

Melhem says he regrets the unfavorable decision and that, curiously, it leaked. For him, the effort of Dani Calabresa and his lawyers to keep the messages exchanged between the two on WhatsApp confidential proves that their thesis on the case is true.

“Marcius Melhem reiterates his position that he would like everything to be exposed in a transparent way. The struggle to keep the messages secret already shows where the truth lies,” reads a statement sent by him.

Dani Calabresa’s defense was also expressed in a text sent to the press: “The 12 women who denounced Marcius Melhem for moral and sexual harassment maintained absolute respect for the secrecy of the trials, also to protect the names of the third parties involved. We regret the continuous leaks that have occurred, always with versions that attack the victims, defend the views of the accused and in the moments that interest him. We believe in justice and we are sure that the truth will prevail “.

The two comedians have fought several legal battles since lawyer Mayra Cotta, who represents actresses Globo, sued Melhem for moral and sexual harassment in an interview with the Folha de S. Paulo newspaper in October 2020. Two months later, Piauí magazine published a report describing serious acts committed by Melhem, presenting Calebresa as a victim of severe harassment.

After publication, Melhem’s defense sent an out-of-court notification to Calabresa, signed by lawyers José Luis Oliveira Lima and Ana Carolina Pivoesana, as a preparatory measure to substantiate a future lawsuit. The legal document reproduced the voice messages sent by the actress, which, according to Melhem, would demonstrate the intimacy she had with the actress. Folha de S. Paulo published the contents of the document, accompanied by an interview with Melhem.

Only then was an investigation request filed with the Federal Public Ministry (MPF) against the former director of Globo and it was decided to initiate criminal proceedings for the fact that he had broadcast audio from Calabresa, with a request for compensation from the moral damage to the actress.

Melhem also filed a request for moral and material compensation against Calabresa for suggesting that he harassed her.

In February Piauí magazine brought new complaints, fueled by information from the accusers, and last month conversations were leaked via What’s App, in a very intimate tone, which contrasts with the content of the accusations made against the former director of the Humor department. from globe.

These messages and voice recordings have been accepted and are part of the process in which Melhem tries to prove his innocence.
