If Stf agrees, Lava Jato contractors will have a 1 billion dollar discount in debt with union

The advantage was negotiated to prevent companies from interrupting the payment of fines generated by the Clemenza agreement

If the majority of the ministers of the Supreme Federal Court (STF) agrees with the vote given on Friday 15, by the Minister André MendonçaThe contractors investigated on Lava Jato will have a discount of $ 1.3 billion in debt with the union. The amount refers to the fine and interest in the unpaid installments.

The amount also includes the exclusion of the penalties provided for by the misconduct law.

The discount corresponds to 10.8% of the R $ 12 billion due by the seven companies. After negotiation with the union, the companies paid $ 4.4 billion with the merit of the tax loss. $ 6.2 billion remained for companies to pay.

Mendonça voted in the virtual plenary for the approval of the renegotiation of the clemency agreements signed between contractors and public power. So Minister Flávio Dino asked for a vision. It has a period of up to 90 days to return the process for the continuity of the judgment.

The General Controller of the Union (CGU), the Prosecutor General of the Union (AGU) and the Federal Court of Audit (TCU) participated in the negotiations. If the Supreme Court validates the agreement, the decision will benefit seven contractors: Engevix Engenharia, Andrade Gutierrez, Utc Participaçier, Move Partimaçants (ex Camargo Correa), Braskem, Novoonor and Metha (ex Oas).

The companies asked for the discount to prevent their impossible operation. The Clemenza agreement is a sort of winning delations by the companies: they tell what they know on an investigation from which they are targeted and, in return, receive less punishment than those provided by law.

Rinegotation began to be discussed by an action presented in 2023 by PSOL, PCDOB and Solidarity. The parties questioned the legality of the clemency agreements celebrated between public power and Lava Jato contractors.
