The First Commission of the Federal Supreme Court (STF) has decided to reopen the investigation against Valdemar Costa Neto, president of the Liberal Party (PL), for alleged involvement in the 2022 coup plot. The resumption was defined this Tuesday, 21st, during the trial on core 4 of the coup case before the Court.

Minister Alexandre de Moraes, rapporteur on the case, defended the resumption of the investigation into Costa Neto in his vote, the first of the day. Moraes signaled the request for investigations into the crimes of criminal organization and attempted violent abolition of the democratic rule of law. The majority of the class followed in agreement.
The issue came to light with the decision to condemn Carlos César Moretzsohn Rocha, former president of the Instituto Voto Legal (IVL), which is part of nucleus 4, at the center of this Tuesday’s sessions. It was Rocha who produced fraudulent reports on the functioning of the polls, documents that were used by the PL to justify a request for an extraordinary verification of the votes.
In the end, Rocha was convicted this Tuesday of the crimes of armed criminal organization and attempted violent abolition of the democratic state – being considered innocent, due to lack of evidence, of the charges of coup d’état, qualified damage and deterioration of protected property.

“I determine, according to the terms of the vote, the sending of complete copies of Criminal Action 2694, this Criminal Action to PET 12100, so that, pursuant to Article 18 of the Code of Criminal Procedure, the investigations relating to Valdemar Costa Neto can be resumed, with regard to the crimes of criminal organization and attempted violent abolition of the State of Democratic Law, to the detriment of the convicted”, concluded Moraes, at the end of the session.
Valdemar Costa Neto had been indicted by the Federal Police in the case, identified as financing and encouraging the campaign aimed at discrediting electronic voting machines. But he was not reported by the Attorney General’s Office (PGR) at the time.
