Globo is sentenced to pay R$100,000 to a teacher for improper use of music

Globo was ordered to pay R$100,000 to nursery school teacher Alda Bezerra, for the unauthorized use of a Big Brother Brasil song, without due credit. The broadcaster appealed, but withdrew and entered into a payment agreement, which was approved on January 9.

Globo was ordered to pay R$ 100 thousand to early childhood education teacher Alda Bezerra, for use not allowed of a song in Big Brother Brazil. The case happened in 2019, when the broadcaster used the song “Despedida” composed by the teacher, but did not give credit for it.

Alda Bezerra has a successful YouTube channel. On the platform the educator has around 281 thousand members, and shares educational content aimed at early childhood education and some compositions.

A snippet of one of her songs was used in contestant Hana Khalil’s elimination episode. However, the teacher told the court, Globo did not mention her name in the credits and did not make any payments for the use of her voice and composition.

In the trial, the broadcaster declared that it had acted in good faith, that the song was not registered with any official body and that it had tried to identify its authorship through an agreement with the Brazilian Union of Music Publishers, but without success.

“The author could have contacted Globo to regularize the use of the work, but she did not do so”, stated the broadcaster’s defense in the trial, published by UOL.

Globo was convicted in the first and second degree. Initially, the broadcaster had appealed to the Superior Court of Justice, but, before the new trial, it had given up and signed an agreement which provided for the payment of R$ 100,000 to the teacher, in addition to another R$ 15,000 in compensation to the his lawyer.

The agreement was approved by the Court on January 9, according to columnist Rogério Gentile.

OR Earth contacted Globo consultants and Professor Alda Bezerra for comment on the matter, but did not receive a response until this article was published. The space remains open for demonstrations.
