Federal deputy was sentenced in the second instance for publishing homophobic videos in 2017; He intends to appeal the decision
The federal deputy Marco Feliciano (PL-SP) was ordered to pay compensation for moral damages to Lucinha Araújomother of the singer Cazuza. The stipulated value is R $ 80 thousand.
The decision, in the second instance, is from the 16th Chamber of Private Law of the Labor of the Court of Rio de Janeiro (TJ-RJ).
Feliciano, who is also an evangelical pastor and intends to resort, used social networks to post homophobic videos with the use of image and work of Cazuza, who died in 1990, to attack the homosexual community as well as the artist’s honor. The publications were made in 2017.
After being convicted in the first instance, the federal deputy appealed, unanimously rejected by the judges of Rio.
Feliciano claimed that the value court in the posts would be of his voters and that he would be protected by parliamentary immunity. In the text of the decision (via CNN Brazil), the judges rejected such an argument because they understood that the deputy “It extrapolated the limits of your parliamentary activity”.
“Although the defendant may claim that his speech would meet what his electorate wants him to defend on the stands, this cannot be seen as a blank letter to allow the spread of hate speeches.”
Lucinha Araújo, Cazuza’s mother, called the court in 2017, when the posts were made. She asked for the removal of the content and compensation of $ 120,000.
